By accessing or using Chamoisly ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Chamoisly is a marketplace platform that allows users to:

• Browse and download 3D models
• Upload and sell 3D models (as verified sellers)
• Purchase premium memberships for enhanced features
• Interact with the community

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use
• Be at least 13 years of age

3.2 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms, fraudulent activity, or prolonged inactivity.

4. User Content and Licenses

4.1 Your Content

When you upload 3D models or other content ("User Content"), you:

• Retain ownership of your intellectual property rights
• Grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content
• Warrant that you have the right to upload and distribute the content
• Are responsible for ensuring your content does not infringe third-party rights

4.2 Content Guidelines

You agree not to upload content that:

• Infringes copyrights, trademarks, or other intellectual property
• Contains malware, viruses, or malicious code
• Is illegal, harmful, threatening, or abusive
• Contains adult content or is inappropriate
• Violates any applicable laws or regulations

4.3 License Types

Models downloaded from Chamoisly come with licenses:

• Personal License: For non-commercial use only
• Commercial License: For commercial projects (Premium users only)

5. Payments and Subscriptions

5.1 Premium Membership

Premium subscriptions:

• Are billed monthly via Stripe
• Auto-renew unless canceled
• Can be canceled anytime from your account settings
• Refunds are not provided for partial months

5.2 Seller Revenue

If you sell models on our platform:

• We retain a platform fee of 20% per sale
• Payments are processed via Stripe
• You are responsible for applicable taxes
• Minimum payout threshold is $50

5.3 Refund Policy

Digital downloads are generally non-refundable. Refunds may be issued at our discretion for technical issues, duplicate purchases, or fraudulent transactions.

6. Intellectual Property

The Platform and its original content (excluding User Content) are protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or distribute our platform code or design
• Use our trademarks without permission
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

7. Prohibited Activities

You agree not to:

• Use automated systems (bots, scrapers) without permission
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Platform's operation
• Impersonate others or provide false information
• Engage in fraudulent activities or money laundering
• Harass, threaten, or abuse other users
• Circumvent any security or access controls

8. Third-Party Services

Our Platform integrates with third-party services:

• Stripe: Payment processing
• Google OAuth: Authentication
• Discord OAuth: Authentication
• Supabase: File storage

These services are governed by their own terms. We are not responsible for third-party service failures or data breaches.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or availability of content
• That the service will be uninterrupted or error-free
• That defects will be corrected
• Security of data transmission

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAMOISLY SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or use
• Damages arising from User Content or third-party content
• Damages exceeding the amount you paid us in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Chamoisly, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

12.2 Arbitration

Any disputes shall be resolved through binding arbitration rather than in court, except for small claims court matters.
